PROCEDURES FOR REGISTRATION OF NON GOVERNMENTAL ORGANIZATIONS
UNDER THE NON GOVERNMENTAL ORGANIZATIONS ACT, NO. 24/2002.
1.0 REGISTRATION
PROCEDURES
The registration of Non Governmental Organizations in
Tanzania is divided into different levels so as to facilitate
registration in District, Regional, National and International
levels respectively. The Law provides for appointment
of Public Officers to facilitate registration in the
District and Regional levels, where the District Administrative
Secretaries (DAS) shall facilitate at the level of District
and the Regional Planning Officers shall facilitate
registration at the Regional level. Reference is made
to Sections 22(1) and 23 (1) (2) (3) of Non Governmental
Organizations Act, No. 24 of 2002. The procedures for
registration are as follows:
The application for Registration
of a Non Governmental Organization shall be accompanied
by the following; as per Section 12(2) of the Non Governmental
Organizations Act.
a) Copy of Constitution of the Non
Governmental Organization
b) Minutes containing full names and signatures of founder
members
c) Personal particulars of office bearers
d) Address and Physical location of the head office
of Non Governmental
Organization
e) Application fee
f) Any other particulars as may be required by the Registrar.
The application for Certificate
of Compliance shall be accompanied by the following;
a) Copy of Constitution of the Non Governmental Organization
b) Certificate of incorporation
c) Minutes containing full names and signatures of founder
members
d) Personal particulars of office bearers
e) Address and Physical location of the head office
of Non Governmental
Organization
f) Any other particulars as may be required by the Registrar.
Application for registration of
Non Governmental Organization shall be in the prescribed
form NGO A form No.l and the application for Certificate
of Compliance shall be in a prescribed form NGO A form
No. 3.
2.0 ROLES AND DUTIES OF
ASSISTANT REGISTRARS IN FACILITATING REGISTRATION OF
NON GOVERNMENTAL ORGANIZATIONS
The roles and duties of Assistant Registrars,
according to Section 22 (2) (a) and (b) of the Non Governmental
Organizations shall be:
- To register Non Governmental Organizations within
the Region or District for which he is appointed on
behalf of the Registrar,
- To issue certificates of registration or certificates
of Compliance as the case may be, on behalf of the Registrar.
Assistant Registrars shall be responsible
to facilitate registration of Non Governmental Organizations
operating within the District or Region in which they
are appointed.
Main Responsibilities:
To receive applications for registration or compliance
from NGOs within its District or Region
To peruse all necessary documents attached with the
application
To verify all applications, this might include physical
visits to NGOs offices/activities
To recommend on whether the particular NGO can be registered
If the Assistant Registrar is satisfied by the applicant's
application, he may direct the particular applicant
to deposit all the fees necessary lo the given bank
Account.
To give reasons and comments on why the particular NGO
shall be refused registration.
To forward and submit the applications attached with
a valid Bank receipt of payment of necessary fees together
with his recommendations to the Registrar for registration
and issuing of Certificates.
To receive all Certificates of registration or compliance
and distribute to the applicants concerned.
To receive Notification of refusal of registration Form
also NGO A FORM No.5 and deliver it to the relevant
applicant.
To resolve minor misunderstandings among the NGOs within
its Region or District amicably.
To oversee social welfare of the NGOs within its Region
or District.
Receive annual audited Report and submit the same the
registrar for filing.
Remind and Direct applicants to deposit annual fees
to the given Bank Account after completion of each year.
To keep and update Register of all NGOs registered in
its District or Region.
To make use of various prescribed forms attached in
the First Schedule of the Regulations
To forward and submit to the Registrar all names and
addresses of registered NGOs who defaulted the terms
and conditions for registration and comment clearly
on each NGO mischief/misconduct.
Receive Default Notice Form NGO A FORM No. 7 or Notice
of cancellation Form NGO A FORM No.6 and deliver to
the applicant/NGO concerned.
3.0 OTHER IMPORTANT FACTORS
TO CONSIDER DURING REGISTRATION PROCESSES
3.1 Levels of Appeals
In the event that an applicant is not satisfied by decision
of the Assistant Registrar may appeal to the Registrar.
Or where an applicant is not satisfied by the decision
of the Registrar, can further appeal to the Board or
to the Minister when not satisfied by the decision of
the Board for final determination.
3.2 Applicable Fees
The fees applicable for Registration under District
level shall be Shs 41,500/= as follows:
- Filing fees shillings 15,000/=
- Registration fees shillings 25,000/=
- Stamp duty shillings 1,500/=
The fees applicable for registration
under Regional level shall be Shs 56,500/= as follows:
- Filing fees shillings 15,000/=
- Registration fees shillings 40,000/=
- Stamp duty shillings 1,500/=
The fees applicable for registration
under National level shall be Shs 66,500/= as follows:
- Filing fees shillings 15,000/=
- Registration fees shillings 50,000/=
- Stamp duty shillings 1,500/=
The fees applicable for registration
under International level shall be USD 267 as follows:
- Filing fees shillings USD 15
- Registration fees shillings USD 250
- Stamp duty shillings USD 2
Each Registered NGO shall pay an annual fees of shillings
50,000/= or USD 60 for International Non Governmental
Organizations.
NGOs obtained Certificate of Compliance shall also be
required to pay annual fees after completion of one
year since they obtain such Certificate of Compliance
under this Law.
Each registered NGO shall submit annual activity report
and annual financial audited reports at the end of each
calendar year, using the prescribed known as NGO A Form
No. 10.
The National and International Non
Governmental Organization shall be registered directly
by the Registrar.
4.0 PROCEDURES FOR PAYMENT OF APPLICATION /
ANNUAL FEES
All payments of applications/annual fees shall be as
follows:
i. NGOs registered at District and Regional levels shall
deposit their fees in the Account Number 16:29 Miscellaneous
Deposit (This is the Sub-Treasury Account located in
every Region) in the National Microfinance Bank (NMB)
Branches.
ii. NGOs registered at National
and International levels shall make their
payments in the Account Number 16: 140 Miscellaneous
Deposit or shall pay directly to the Accounts Department
in the Vice President's Office and official receipts
issued for the related payments.
Other Procedures
According to Regulation 5 (1) (2)
(3) of Regulations made pursuant to this Act No.24/2002
all applications, returns, notifications shall be clearly
and legibly written in English or Kiswahili Language
and if there is any Translation of foreign Language
other than English then the translation shall be verified
to be the true translation in English or Kiswahili.
Prescribed Forms
There shall be several prescribed forms to be used in
the overall process of Registration. NGO A Form No.l
and NGO A Form No.3 shall be used by the applicants
in the application for Registration and application
for Certificate of Compliance respectively.
NGO A Form No.5 shall be used by
the Registrar's Office to serve as Notification for
refusal of registration to the applicant.
NGO A Form No. 6 shall be used by
the Board to serve as the Notification of cancellation
of registration.
NGO A Form No. 7 shall be used by
the Registrar's Office to serve as Default Notice, incase
the registered NGO defaulted the terms and conditions
of registration.
NGO A Form No. 8 shall be used by
the Registrar's Office to serve as Summons.
NGO A Form No. 9 shall be used by
the applicants to serve as Notice of Change of particulars
of registered Non Governmental Organization.
NGO A Form No. 10 shall be used
by the applicants to serve as Annual report Form, which
shall be submitted at the end of every calendar year.
